I need assistance drafting a motion for reconsideration related to a child custody case. The primary reason for this motion is to address a palpable legal error in the original decision. The judge sent it back to arbitration without seeing my evidence which proves i had him for ywo years and she only showed up because her child support was raised! Shes money motivated! Her own mother admitted it in text messages! We're only here because the maternal grandmother wouldn't return him from a visit! I have ordered that police report where they couldn't return my son and advised me to get legal custody! I have dhs paperwork showing he's been on my case since 2024! She didn't show up for hearings! I had a judge say I didn't have to share custody with the grandmother and sent it back to arbitration and my proposal was full custody and she showed up to ask that it be 50/ 50 to lower her child support! Now the judge says she can leave him with her mother on her time! Which again I'm being nade to share custody with the grandmother! I have text messages with the grandmother to prove she's not a mother to her kids! The grandmother is being rewarded for stealing my son! I just want him back and this is not good for the stability of my son! I've been caught in a legal loop for over a year now! She never takes him only her mother does! She said she leaves him with her mother for school! I moved so he could go to school of choice and she deceived the court with her answer! Her mother lives .9 miles where as she lives 1.9 miles from the school! I have copies of google maps to substantiate! I have custody of my daughter and my elest son aged out of this process and lives with me! We are now a broken family! The dhs records will prove who is on my case cuz my other children are included! I have applied for disability and am in that process to date! I've never denied either of them visitation! The grandmother caused this not the mother! When the police came to the grandmothers, the mother didn't even come! They spoke to her on the phone! She doesn't want him! She doesn't take him for any visits to establish a mother and son bond! Only the grandmother does! She steals the income tax every year! She put a pin on their socials even though they both live with me! She probably took them herself for a visit only once a year! Which further proves my point, she's financially motivated! When she deserted and abandoned us she tried to keep the foodstamps! About 1000 dollars for which she was tossing Ramen noodles through the door! She was giving them away to her cousin and mother! So my mother taught me how to get them for my own family and became my representative and power of attorney! She became irate with my mother and was screaming I know you did this! She stole my sons nike shoes on the way out the door cuz they fit her! My mother replaced them along with nike boots and a whole new nike wardrobe! I've used my clothing order for school supplies and clothes while she has not contributed a dime to their health and well-being! Not so much as a pencil! Shes deceived the school by going online and changing her address to her mothers! She's very tech savvy and I am not! Now I can't get paperwork even though my son told them he lives with me and he told them where she lives! I have brain issues and she uses that to her advantage! Her tax returns will prove she claims our sons but doesn't have them! My mother is helping us not her or her mother! Because I talk backwards or have a hard time talking at all, the judge cut me off and ddidn't allow my evidence to come into play! Shes a good talker I am not! Most of what she says are lies! I have her own mothers text messages and the police report, the dhs records, and the geographical maps as proof! My mother could provide receipts i think as proof cuz she bought his stuff online! We never dreamed it would come to this! I also have a bunch of witnesses that I've always taken care of my children! I've never left them since they were born! 20 years or more! My eldest daughter moved out when she had a baby and moved in with the working father! Our relationship still stands strong! I want to reiterate i only want my son back! I've never not had him! This is not in the best interest of the child! This continuas loop has gone on too long! My son is going to age out at the rate we are going! We started this when he was 14! He is 15 now! She has a 3 bedroom house but her boyfriend doesn't want my children there! It disrupts their life! She'd rather pay her mother to keep him because its cheaper than child support! I have texts to prove that too! I never dreamed that after two years of solely having my son! Uprooting to apease his schooling! A father taking excellent care of his son! When most fathers run off that the grandmother could reak such havoc by stealing him! His mother doesn't want him herself, she wants him for her mother! I thought maybe this would force her to be a mother! It did not! This has only further confused him! She only wants control so the optics look good in her favor! Shes not for the children or their best interests! She's all about herself and her boyfriend and his kids! She has a new life so let her have it! Just please let us have ours! The way it used to be! The court is confusing my son! Hes abiding by his mother having every other weekend! Its not in his best interest to change that! By the way she doesn't want him then either! He just says its her time every other weekend and heads to his grandmothers house! He knows hes not allowed at his mothers and doesn't want to go there anyway! He goes to his girlfriend who lives blocks from his mothers! He does not visit her! He goes back to his grandmothers to spend the night! When her weekend is over he comes back home! His hygiene is also in question with the grandmother! When it was every other week, she didn't make him shower or brush his teeth or hair! He would return in the same smelly clothes! I make him do these things so he is clean for school again witb me! We are back to normal! Then here she comes to disrupt us again! These are the reasons I need to file a motion to reconsider! Before everything gets blown up again!
