I am a secure tenant, a registered social housing provider, at a property in Edenbridge, where I have lived since November 2010. In May 2024, a previous County Court claim against the housing disrepair was settled by way of a Tomlin Order, without admission of liability. That settlement covered issues up to May 2024 only. Since the settlement, further disrepair has occurred, along with what I believe is a breach of the settlement's own terms. I have also experienced a pattern of inconsistent and harassing treatment by — including situations where my landlord has taken swift, formal legal action against me over minor issues while leaving comparable problems caused by their own contractors, or by other residents, unaddressed for extended periods. One example: I was left without a working fridge freezer for over 14 months (October 2024 to January 2026), despite more than 30 emails and escalation to director level, before it was finally replaced. I am also affected by ongoing personal injury and psychiatric injury arising from the prolonged disrepair and its impact on my health and my household, which includes a disabled child. What action I would like to take: I want to bring a civil claim against the housing covering the breach of the 2024 Tomlin Order, the disrepair and harassment since that settlement, and the related personal injury and psychiatric injury. I would like to understand the strength of this claim before deciding how to proceed with issuing proceedings.
