ENGAGEMENT REQUEST – TRAFFIC MATTER Sunshine Magistrates' Court – 7 September 2026 1. THE CHARGE Charge: Fail to obey red traffic arrow – Road Safety Road Rules 2017, Rule 60 Date: 4 September 2025 at 11:05 AM Location: Duke Street & Ballarat Road, Braybrook Vehicle: UGO 327 Plea: NOT GUILTY Next Hearing: 7 September 2026 – Mention Hearing 2. MY DEFENCE – VERIFIED ALIBI I have independent evidence proving I was NOT driving: Exhibit A – Payslip & timesheet: I was at work from 7:00 am to 7:00 pm on 4 September 2025. Exhibit G – Employer's letter: Signed letter from my manager confirming my vehicle was parked at work during my shift. Exhibit H – Diary note: The prosecutor called me on 17 March 2026. My manager spoke to him and confirmed my alibi. The prosecutor raised no challenge. My alibi covers the entire day. If the prosecution argues the camera date was wrong, I was still at work all day with my vehicle parked at work. 3. PROSECUTION'S ADMISSION (EXHIBIT I) The prosecution's brief contains a formal admission under s 37(2)(e) of the Criminal Procedure Act 2009: - They POSSESS a "Certification Certificate for Camera". - They DO NOT INTEND TO TENDER IT as evidence. If the certificate helped their case, they would use it. Their refusal suggests it does not. The prosecution also relies on a certificate under s 83A dated 25 October 2024 – almost 11 months before the alleged offence. It does not prove the camera worked on 4 September 2025. My evidence rebuts the presumption. 4. WITNESS STATUS My witness, Mr Andrew Torchia, has provided a signed letter (Exhibit G). He has now withdrawn from giving oral evidence due to personal issues. I will not force him. I rely on his written statement as a business record. 5. WHAT I NEED FROM YOU I require full representation including court appearances. I need you to: 1. Review my Defence Statement and Exhibits A–I; 2. Prepare and serve a formal Notice of Alibi (Form 14) under s 190; 3. Prepare, file and serve a formal application under s 46 for a disclosure order; 4. Negotiate with the prosecution to seek withdrawal; 5. Represent me at the Mention Hearing on 7 September 2026 and all subsequent hearings. I am prepared to pay a reasonable fixed fee for this service. Please quote your fee in your response. 6.
